Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.
The case stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling allegations, he was held in federal custody.
In her order, the judge pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
Context of the Case
The legal proceedings center on conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in Tennessee.
Conditions of Freedom
The judge, who was hearing his challenge to deportation in a federal court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This ruling marks a notable turn in a complicated legal case involving allegations of wrongful detention and disputed criminal associations.
